The Delhi High Court has refused to stay the OTT release of Dhurandhar: The Revenge in a copyright case over the alleged unauthorized use of Tridev’s iconic song ‘Tirchi Topiwale’.According to Live Law, Justice Tushar Rao Gedela refused to grant interim relief to Trimurti Films Private Limited, which sought an injunction against the exploitation of the song and its remixed version “Rang De Lal (Oye Oye)” on film and digital platforms.However, the court held that Super Cassettes Industries Pvt. Ltd., popularly known as T-Series, to deposit Rs 50 lakh before the court within four weeks.
The court says damages can be awarded later if rights are proven
Trimurti Films argued that under a 1988 agreement, Super Cassettes Industries was only assigned limited audio rights and was not allowed to dub or include the song in another film.The production house claimed that the use of the song from ‘Dhurandhar: The Revenge’ infringed its copyright in literary, musical and sound recording works related to the song.The defendants, including B62 Studios Pvt. Ltd. and Jio Studios objected to the complaint and deletion of the alleged facts by Trimurti Films. They argued that songs from “Tridev” had previously been used in films like Azhar and KGF: Chapter 1 without pursuing legal action.Refusing the OTT release of the film, the judge observed that even if Trimurti Films manages to prove its copyright claims later in the trial, it can be adequately compensated through damages.
Rs 50 lakh should be deposited in concerned FDRs
The court directed T-Series to deposit Rs 50 lakh in the name of Registrar General within four weeks. The amount will be invested in an interest-bearing Fixed Deposit Receipt (FDR) with a self-renewing clause, and the successful party will receive its benefit at the end of the trial.Dhurandhar: The Revenge will begin streaming on Netflix from May 15, 2026, and is expected to release on JioHotstar in India, where viewers will reportedly get a 3-hour, 52-minute extended version of “Raw & Undekha” with additional footage not screened in theatres.
