Now, according to the latest update, the court has issued a John Doe injunction ordering the removal of fake content that allegedly violates YouTubers’ privacy rights. The directive was accepted by the Justice Jyoti Singh While Bam was hearing a lawsuit filed against various parties, including unidentified defendants (John Does), e-commerce platforms and social media intermediaries.According to LiveLAw, Bam argued that while a previous injunction dated January 13 protected his identity rights, his likeness and features continued to be used without permission on various platforms. These included fake and infringing videos, as well as unauthorized commercial listings on online marketplaces. Granting interim relief, the Court found that Bam had successfully established a prima facie case and that the balance of convenience was in its favour. He also warned that refusing the order could cause irreparable damage not only to him, but also to unsuspecting citizens.“You are prohibited from creating, posting, communicating, publishing, offering for sale, distributing, circulating or otherwise exploiting any content, merchandise, publication or digital material that infringes the personality/publicity rights and/or copyright of Defendant No. 10/Plaintiff John Doe.”The order also requires Google LLC to remove YouTube links, and Flipkart and other online marketplaces have been asked to remove listings of infringing goods. Additionally, Spotify has been ordered to remove certain playlists or shows, and Meta Platform must remove related Instagram content. Justice Singh also considered the objections raised by some of the defendants who claimed protection under the parody exemptions, stating that the matter would be considered in detail later after hearing all the parties involved.
