Celina JaitleyPeter Haag, who has been embroiled in a legal battle with her married husband Peter Haag, has been served two legal notices by Peter Haag and his father-in-law, Dr. Wolfgang J. Haag. The notices relate to allegedly defamatory statements made in public during the couple’s matrimonial and child custody proceedings in Austria.
Peter Haag and father-in-law object to public statements
According to legal notices reported by IANS, Dr. Peter Haag and Dr. Wolfgang J. Haag have objected to what they describe as “unverified and defamatory allegations” made against Peter Haag and members of the Haag family through interviews, social media posts, public statements and media publications. The ads say that although proceedings related to marriage and child custody are currently being heard before Austrian courts, the case has increasingly attracted public debate and media coverage.Several narratives circulating in the public domain allege unverified claims of harm to Peter Haag and his family.
Concerns have been raised about the impact on minor children
A major concern highlighted in the ads is the welfare and privacy of the couple’s three minor children. The adverts stress that matters involving children should be dealt with “with the utmost privacy and sensitivity” and not be subjected to what they describe as a parallel trial by the media.Peter Haag and his father have requested that the publication and dissemination of the allegedly defamatory content cease immediately. They have also requested the removal of the disputed material, a public explanation and an unconditional apology, as well as more public statements about the ongoing legal proceedings and the children. In addition, media organizations and digital platforms have been advised to refrain from publishing allegations that have not been independently verified.
Commentary on the dispute from legal experts
Commenting on the issue, Advocate Yesha Shah, Partner, Semwal & Co., said that while laws to protect women remain vital safeguards, marital disputes should not be litigated through media narratives.“Laws passed to protect women are among the most important safeguards in a civilized society. However, when marital disputes become public media trials through unverified allegations and emotional narratives, the very sanctity and purpose of these laws is diluted.” Legal remedies should be instruments of justice and protection, not instruments of public malice or reputational destruction,” Shah said. The notices further state that in the event of non-compliance, Dr. Peter Haag and Dr. Wolfgang J. Haag have the right to initiate appropriate civil and criminal proceedings. These may include compensation, damages and claims before competent courts.
