The actress is reportedly still pursuing him, allegedly seeking damages, even after reaching a “settlement” before trial.According to recent reports from the Daily Mail, Lively is asking a federal court in Manhattan to allow experts to quantify her losses from her $400 million failed defamation lawsuit against Baldoni to determine her financial losses as a result of the now-dismissed defamation suit.At a hearing on Monday, lawyers representing Lively reportedly argued that the actress should present expert testimony to assess damages. According to the report, Lively’s team alleges that the actress caused significant damage to her public image and career prospects, entitling her to compensation under applicable statutes. In addition to attorney’s fees and litigation costs, the actor is reportedly seeking higher damages, including treble damages and compensatory damages. However, Lively refuses to give an exact figure.According to attorney Michael Gottlieb, Baldoni’s complaint allegedly affected Lively’s reputation and professional opportunities.At the same time, Baldoni’s legal team argued that a separate proceeding would effectively reopen the already settled legal battle. Baldoni’s attorney, Ellyn Garofalo, also told the judge that there is no evidence that Lively suffered any measurable harm as a result of the defamation action. He said holding a stand-alone damages trial would amount to an “alternative trial” and could significantly prolong a dispute.Judge Liman was skeptical of this evidence presented to the court outside of a trial. He also questioned whether these complex allegations were properly evaluated outside of a full jury trial.Speaking to the media after the hearing, McCawley said that Lively had made the decision to move on and acknowledged that “the damage [to Lively]they are very significant.”He added, “When you look at the damage done, that’s what he’s looking to compensate, along with attorney’s fees and costs, and then the statutory orders that get in the way.”Lively previously sued Baldoni, accusing him of sexual harassment and allegedly orchestrating a “smear campaign” to damage her reputation. Baldoni denied the allegations and sued Lively for $400 million in damages.
