The promise of equitable education in America is clear: every child, including those with disabilities, should receive adequate support in school. But a new federal investigation shows that promise is not being fully realized in the nation’s capital.The US Department of Education’s Office for Civil Rights (OCR) has found that the District of Columbia Public Schools (DCPS) system failed to provide adequate services to students with disabilities. The agency said the system violated important federal laws and left many students without the supports they need to learn.
Federal investigation identifies legal violations.
The findings came after an investigation launched in March 2025. OCR concluded that DCPS violated both Section 504 of the Rehabilitation Act of 1973 and Title II of the Americans with Disabilities Act of 1990.In a statement to the press release, Assistant Secretary for Civil Rights Kimberly Ritchie said the school system has “massively violated” disability rights laws. He added that many families struggled to get services that should have been provided without a fight.
Long delays and lack of proper support
According to OCR, many students waited months just to be assessed. In some cases, the wait stretches to four months or more. These delays meant that students could not receive timely support, which is critical to their development.The report also found that untrained staff were sometimes making decisions about students’ needs. This is against the rules, which require trained professionals to handle such decisions.In some cases, services were even removed from the student’s plan. This may happen if the staff member runs out of time or feels that the student is not motivated. OCR said such actions are not acceptable under federal law.
Transportation issues raise safety concerns.
The investigation also identified serious problems with school transportation for students with disabilities. OCR said the system has no adequate means of ensuring safe and reliable transport. There were reports of long delays, cancellations and poor coordination. The agency noted that these issues could put students at risk.Similar concerns were previously raised by the District of Columbia Advisory Committee to the US Commission on Civil Rights. In a December 2024 report, the committee said the district had the highest complaint rate in the country when it came to disability education services.
Families are forced to fight for basic rights.
