After the release of ‘Dhurandhar 2’, the makers faced legal trouble as Trimurti Films filed a case against the film for using the remixed song ‘Oye Oye Tirchi Topi Wale’ as ‘Rang De Lal’. Now as per the latest update, Delhi High Court he has refused to be a filmmaker Aditya DharFor using the song in the OTT version of the movie ‘Dhurandhar: The Revenge’. The court stated that the officials had already invested a lot of money, time and effort in the project based on the agreements signed with the T-Series music label.A bench headed by Justice Tushar Rao Gedela, in an order passed on Thursday, observed that Aditya Dhar’s production house and Jio Studios could not now be put at a disadvantage or forced to suffer huge financial losses due to Trimurti Films’ delayed approach to the court for alleged copyright infringement.“In the present case, the 1st defendant and 2nd defendant have invested huge money, time and efforts in the surety and the agreement with the 3rd defendant in the production of the motion picture ‘Dhurandhar: The Revenge’ and they cannot now be put in a prejudicial or disadvantageous situation and suffer huge financial loss, and when they only choose to plead, wake up from their deep slumber,” the court said.The court also stated that allowing the song during theater while banning it on OTT platforms would lead to a practical situation.“Whereas the presence of the alleged infringing song/remixed version in relation to the broadcast of the said film in theatres/cinema halls would be permissible, in so far as OTT platforms are concerned, it would constitute an act of infringement. This, in the opinion of this court, cannot be inconceivable and cannot be said to be mandated.”At the same time, to maintain fairness, the court directed T-Series to deposit Rs 50 lakh with the Registrar General within four weeks.
