According to Billboard, the lawsuit was filed by an electric violinist who performed on the ‘Based on a True Story’ tour.On Tuesday, May 5, the court order granted Will Smith’s request to withdraw the claims filed by Brian King Joseph in December.

The violinist, who came in third place on America’s Got Talent in 2018, has alleged that she was “illegally fired” from the actor’s international tour after someone broke into her Las Vegas hotel room and left sexually suggestive material, Billboard reported.A note was also found with the material, “Brian, I’ll be back.”
The judge rules on evidence, not workplace sexual misconduct
Judge Michael Shultz stated that while the remark was sexual in nature, its existence does not rise to sexual misconduct in the workplace.The judge also said it is unreasonable for Joseph to assume without evidence that Smith or one of his employees is to blame for the alleged breach.“The allegations do not allege a severe and pervasive pattern of harassment sufficient to create a hostile work environment,” the court’s order states.Additionally, the court said that the deficiencies in the case not only precluded Joseph’s claims of sexual harassment, but also allegations of wrongful termination and retaliation.
