Judge Michael Shultz stated that while the remark was sexual in nature, its existence does not rise to sexual misconduct in the workplace.The judge also said it is unreasonable for Joseph to assume without evidence that Smith or one of his employees is to blame for the alleged breach.“The allegations do not allege a severe and pervasive pattern of harassment sufficient to create a hostile work environment,” the court’s order states.Additionally, the court said that the deficiencies in the case not only precluded Joseph’s claims of sexual harassment, but also allegations of wrongful termination and retaliation.

Will Smith has been accused of “predatory behavior”.
